A claimant in an open accusation has filed a writ of summon, challenging Da Philemon Mutang, HRH Da Nelson Andak Bakfur, the Mangu Traditional Council, the Attorney General of Plateau State and Mangu Local Government over chieftaincy title of the ruling house of Kohopang .
The writ which was issued by Barr. E .O Akhayere ESQ, of NO 16, New Zaria Terrace ,off Tafawa Balewa Street ,Jos, said the case has been adjourned to 8 of March, 2018 for the continuation of hearing .
The Plaintiff, Mr Ezra Chirang in a suit No.PLD/J20 CV/2014 said the the selection of the 1st defendant as the district head as “MISHKAHAM” of Kerang is null ,void and of no effect whatsoever since it was not done in compliance with the native law and custom relating to the selection of the district head of Kenang .
In his suit dated 15th April, 2015 and filed same day, Chirang said an order of injunction was given restraining the 1st defendant from presenting himself for installation /coronation as the district head of Mishkaham of Keran. The order of injunction also restrained the 2n,and 3rd defendants from recognising the 1st defendant as the district head Head Mishkaham of Kerang respectively.
The 1st defendant is a farmer resident in Kerang in Mangu local government area of Plateau state within the jurisdiction of this honourable court .
The 2nd defendant is the Mishkaham Mwaghavul and president of Mangu traditional council and resides in Kerang in Mangu local government area of Plateau state within the jurisdiction of this honourable court
The 3rd defendant is the Mishkaham of Mwaghavul Development Association, Kerang branch and resides in Panyam in Kerang and also known as Mishkaham Kerang, all the adult male of the family of Kohopang including himself, who are eligible to be selected as the district head Mishkaham of Kerang.
The plaintiff avers that in Kerang there are three ruling houses namely; Kohopang, Kohogwen and Pulukum from which the district head of Kerang is selected.
The plaintiff avers that by the native law and custom relating to the selection of the district head Mishkaham of Kerang the district head is usually selected by Chief Priest Sarki Tsafi from any of the three ruling houses who then presents the person so selected to the people for installation.
He stated that the 2nd defendant was the district head Kerang prior to his elevation to the position of the Mishkaham of Mwaghavul and chairman of the chairman of the Mangu traditional council.
