A Plateau High Court sitting on Monday has ordered the Jos Distribution Company of Nigeria, DISCO, to pay the sum of N20,000.00 to, Chief Achi Chijioke for failure to comply with the proceedings of filing out of time.
Chief Chijioke, Plaintiff had complained to court that the defendant (Jos Electricity Distribution Company of Nigeria) invaded his privacy by entering his shop located at Ahmadu Bello way, destroyed goods and tempered with some of his essential documents.
He said the Disco staff disconnected his light in his absence.
Counsel to the plaintiff ,Barr A.B Cobby told the court that the matter was slated for hearing and he waBs ready to proceed .
However, the counsel to the defendant ,Prof A A Shaka objected to the plaintiff application , saying that he had filed a fresh application asking the court on the issue of jurisdiction .
He said he had filed an application seeking for the interpretation of the suit, whether the state high court had the jurisdiction to entertain this matter. The defendant told the court that he filed his counter defense dated 9th June 2020 base on point of law calling on the court to dismiss the suit for lack of merit.
Justice Musa Ashom overruled him and said the court had the jurisdiction to entertain the matter. He adjourned proceedings to 14th September, 2020 for continuation of hearing and regularization of the defence counsel to commence proceedings.
