Justice Parbong has warned the People Democratic Party (PDP ) under the leadership of the former Minister for Sports and Youth Development, Honourable Damishi Sango to produce all six witnesses before the honourably court or risk dismissal of their suit for lack of merit.
Speaking at the JMDB court sitting in Jos North Local Government Council, on Wednesday, Justice Parbong urged the complainant to assembly all their principal witnesses to allow the court forge ahead and stop the constant adjournment of the pending case.
She said the absence of PDP witnesses in court led by Hon Sango stalled the ongoing hearing in the suit filed on April 8th, 2017 challenging the legality of PDP leadership of Chairmen loyal to the Sen. Ali Modu Sheriff and Senator Ahmed Makarfi factions.
The judge while adjourning the case to November 30, stated that Hon Sango now risks losing as a plaintiff if he fails to produce witnesses against Hon Gyang Badung Chairmanship of the PDP faction loyal to Ali Modu Sheriff, on the next adjourn date .
In a suit filed by Hon Damishi Sango challenging the chairmanship of Hon Gyang Badung of the Plateau state chapter of the party, counsel to Sango, Barr. Weng Dalyop told the court that the witnesses failed to come to court because of the ongoing primaries of the PDP to elect candidates for the state LG poll.
He said the convention involved key officials of the party and most of these witnesses who were deployed to conduct the primaries according to PLASIEC guidelines. He pleaded for adjournment to enable him assembly all the witness.
Responding, Counsel to Gyang Badung and Emmanuel Macham, Barr. N.N Durven said the constant adjournment since when the case was instituted five months ago has continued to cause unnecessary delays which is affecting his clients in many ways .
In his statement, Durven objected to the plea for adjournment as no meaningful transaction has taken place since the suit was instituted, expressing surprise that the plaintiff is now linking the court sitting to the party convention, which he described as sad and cheap blackmail.
He pleaded that the complainant should make all signatories of her witnesses to enable him assembly all their principal witnesses so that the matter can come to an end.
