Engr Jimmy Cheto, a governorship aspirant in the 2019 general elections has got a court order for the auction of his residence and other property to pay-off outstanding debt to his creditor.
In a suit No /PLD/J299/2018 filed brought before the state High Court, Mallam Hudu Musa , creditor /applicant stated the Debtor/defendant, Eng Cheto, had refused to pay back money he lent him for his 2018 governorship aspiration.
Mallam Hudu Musa a businessman who is resident in Jos North LGA of the state said he approached the court over the money he lent to Cheto through one Andrew Ashom, a close associate.
According to him, Ashom approached him to lend Engr Jimmy Cheto funds for the election primaries of his party in 2018.
The Plaintiff counsel, Barr D.K. Miner told journalists that the case is an undefined list dated 9th July, 2018 .
He said he had written two letters to Engr Jimmy Cheto on behalf of his client appealing to him to pay the debt of one million given him but Cheto turned his deaf ears to the pleas.
Miner added that since the matter came up for hearing the case has suffered a series of adjournment because they found it hard to properly serve the defendant until one day the bailiff went found that the defendant was present at home and personally effect service on him.
He disclosed that unknown to them, Cheto had secretly obtained an injunction restraining the plaintiff from effecting judgment. However, Barr Miner said that unknown to the plaintiff the defendant had already “filed a motion for stay of execution and dump it inside the file in court without them receiving serving.
Miner said when the matter came up on 10th August, 2020 for hearing, neither the defendant nor his lawyer was present in court.
On Thursday at about 1:30pm the court granted an order to the plaintiff against that of stay of execution and was given marching order to auction the defendant house for enforcement .
Upon the plaintiff application the defendant stay of execution depending in court was struck out and the court attached his house No 19,Nasarawa road Jos to satisfy the plaintiff judgment of the debt penalty. Justice N.L .Musa in a judgment ordered in that the plaintiff effect the judgment.
