Court Nullifies PDP LGA Congress Election

A High Court sitting in Jos, the Plateau State on Tuesday nullified the ward and Local Government Congress election conducted by the People Democratic Party ,PDP , on the March 23, 2020 for lack of merit and non- adherence to relevant portions of the Electoral Act and the party’s constitution .

The Plaintiff, Alh Aminu Abdullahi, his counsel, Munir Barau Abdullahi and 15 others had approached the  state High No 6 with petition that election did not hold on March 23, 2020 in Jos North, owning to security report indicating that the party could not fulfil section 85 of the party’s Constitution as amended.

However , the defendants counsel, Barr Gyang Zi, filed a suit challenging the submission of the plaintiff and called on the court to dismiss the petition for lack of merit.

Justice Ishaku Kunda in his judgement resolved all the prayers in favour of the petitioners saying, the whole issue collapsed for lacking in merit.

Paragraph 6 of the petitioners counter- affidavit indicated that the result was earlier signed by the Chairman of the election in Jos North, Mr Maxwell’s Ndam and two others Mrs Linda Alfred and Napdong Ndam that election didn’t take place .

However, the following day which is March 24, one Danboyi Gyang allegedly went ahead to manufacture a fake list of a purported kangaroo election that held in connivance with the INEC and PDP officials.

The judge said it found out that the plaintiffs were able to prove their case that election did not hold on the March 23, in Jos north.

The judge explained further  that the process raised so many questions regarding the state order stopping multiple gathering of people of up to 50 during the covid-19 pandemic and the non-compliance with guideline of PDP, which automatically render objections invalid .

While the plaintiff counsel, Barr Abdullahi commended the court “for landslide judgement which is the going to bring unity to PDP family”, the defendant’s, Barr Gyang Zi said they were going study the judgement and decide whether to appeal .
