The presiding judge of the Federal High Court in Abuja, Justice Obiora Egwatu, has recused himself from the asset forfeiture case involving former Attorney-General of the Federation (AGF) and Minister of Justice, Abubakar Malami, SAN, and two others.
Justice Egwatu announced his decision on Thursday shortly after counsel to the parties announced their appearances in court. He informed the court that he would no longer continue with the matter and other related cases, citing personal reasons for his recusal.
Following his decision, the judge ordered that the case file be transmitted to the Chief Judge of the Federal High Court for reassignment to another judge.
The forfeiture proceedings stem from an earlier order made by Justice Emeka Nwite of a sister court. On January 6, Justice Nwite granted an interim forfeiture order on 57 properties suspected to be proceeds of unlawful activities allegedly linked to Malami, directing that the assets be temporarily forfeited to the Federal Government.
The matter is expected to continue before a newly assigned judge, as the court process on the forfeiture of the properties remains ongoing.
