A case at the Federal High sitting in Jos Division, involving factions of Labour Party in Plateau State, has been stalled for continuation of hearing. The party has two separate candidates and their deputies.
The suit was filed by Engr Jack Dung Bot the running mate to the embattled Labour Party governorship Candidate, Amb.Yohanna M.D.Margif, challenging the nomination of Barr Edward Pwajok as the running mate to Dr Patrick Dakum in forthcoming 2023 general elections.
The new judge told the petitioner that due to his health conditions he has to retransfer the case file to the Attorney General of the Federation to be reassign to another judge to continue with the proceedings of Labour party (LP) pre-election.
The recent pronouncements by the attorney general of the federation that all preelection matter should end before the 30th of November ,2022 to pave way for the period of electioneering campaign across the country.
However, when the matter came up for continuation of hearing, the judge pronounced that the matter wont continued owning to his ill health.
The petitioner, Jack Dung is challenging Dr Patrick Dakum for picking Barr. Edward Pwajok SAN, as his running mate haven’t exhausted the ongoing litigation in court.
Counsel to the petitioner, Barr.M.A Abdullahi commended the decision of the judge to return the case file back to the attorney general office.
Abdullahi opined that the decision of the Judge to return the case file is in line with recent directives from the Chief Justice, on the setting up pre- elections tribunal to dispense off the interparty suit challenging primaries of various political parties’ cases before the 30th of Nov 2022.
According to him, “it is quite clear now that the case has been returned, the matter will be given accelerated hearing to meet up the date line issued by the Attorney General’s office.
