The Supreme Court has dismissed the Appeal Court ruling against the Oyo State Governor, Seyi Makinde, declaring duly elected governor of the South- western state
All Progressives Congress (APC) and its candidate, Adebayo Adelabu had filed the appeal to seek interpretation of the appeal court ruling whose majority decision favoured him .
The Supreme Court on Wednesday upturned that majority decision of the appeal court on the grounds that its judgment setting aside the ruling of the tribunal was not meritorious and deserved to be set aside.
The court further ruled that the minority decision of the Court of Appeal was more deserving of the apex court’s consideration and upheld the minority decision of the court of appeal which validated Mr Makinde’s election.
Earlier, Mr Makinde’s lawyer, Wole Olanipekun, asked the court to disregard the appeal by Mr Adelabu, arguing that his client had defeated the APC candidate in the polls with over 15700 polls won in 28 out of 33 Local governments in the state.
Similarly, the apex court also upheld the election of Governor Abdullahi Sule of Nasarawa State. The seven-man panel of the court led by Justice Mary Peter-Odili dismissed the appeal filed by David Ombugadu and the Peoples Democratic Party against Sule’s victory at the March 9, 2019 election.
