PDP Crises : Court Sacks Hassan Exco, Orders fresh Congresses in Plateau

A Plateau State High Court sitting in Jos on Thursday sacked the Hon Chris Hassan led Exco of the state Peoples Democratic Party, PDP,  and described the Congress that produced it as illegal and lacking in merit under the law of natural justice.

Justice P.S.Gang made the statement while delivering judgment on a suit filed by the former Member Representing Jos South /Jos East Federal Constituency, Hon Bitrus Kaze, challenging their exclusion from participating in the Congresses conducted by Hon Yakubu Chocho’s care taker committee.

The judgment read that for the National Secretariat of the party to have reappointed Hon Yakubu Chocho into the care taker committee to conduct screening of members, was illegal and unconstitutional based on section 223 of the Constitution, as amended, and section 25(a) of PDP guidelines for the conduct of wards, LGs and state congresses.

The judgment explained further that it was unconstitutional for the PDP exco, whose tenure expired on the June 6, 2020 after a four year tenure, to have presented in July a purported letter claiming to have been sent by the PDP National Secretariat to enable them participate in a new congress and thereby deny other aspirants their chances to contest.

According to the judgment ,the PDP National Secretariat has the right to extent the tenure of exco but that should be done by a neutral state exco that can screen and ensure credibility and transparency in the entire exercise .

The statement said it would amount to tenure elongation if the PDP National Secretariat allowed such an act to continued.

Speaking at the Court premises after the judgement have been entered in his favour, Hon Bitrus Kaze   explained that he was happy, not just because the judgement was entered in his favour but that it has added value to democracy.

According to him, “this is what has disrupted fairness in PDP, this is what fabricated lack of fairness has caused in the party that should have been the envy of all political parties “.

He said that apart from ” side entering judgement in my favour the court ordered for compensation of N2million. So I feel highly honoured that this judgment captured and rejected the essence of the Kangaroo congresses conducted by the Yakubu Chocho led Caretaker committee PDP “.
