EFCC Has Jettisoned The Law, Says Clark, SAN

Mr Robert Clark, SAN, Monday described the failure of the Economic and Financial Crimes Commission (EFCC), to serve the defence counsel alleged charges preferred against his client, Senator Jonah Jang before the state High Court, Jos, capital of Plateau State, as amounting to “the EFCC has jettisoned the laws.” Senator Jonah Jang was however not brought to court because of what the EFCC called ‘ logistic problem’  to convey him to the Court.

Clarke said it was unfortunate that he had to travel all the way from Lagos to Jos, only to be told that the accused persons could not be arraigned before the Court.  He said “it was shocking that until this moment the EFCC could not served us with the alleged charges preferred before the Court”. He further argued that the application was out of point of law.

The inability of the Commission to bring Jang to court was made known by the counsel to the EFCC, Rotimi Jacob SAN, who presented an ex parte motion before Justice Daniel Longji. He urged the court to grant him audience to present the charges against Senator Jang, and Mr. James Simon,  being the accused before the Court, citing sections 116 and 118  of the Criminal Act. 

He  urged  the court to consider  the ex parte motion seeking to present four evidences and copies of exhibits to be presented before the Court. 

After listening to the issues raised by the counsels, Justice Longji, ruled that the application filed by the plaintiff was in accordance with the state law but adjourned the suit to Wednesday, May16 for hearing of the application for bail.
